Terms and Conditions

The Caregiver and WanderSearch Canterbury Charitable Trust (WSC) agree in consideration of, among other things, the mutual promises contained in this document ("Agreement").

1. 1 Introduction.

   1. 1.1 That WanderSearch Canterbury Charitable Trust is the owner of the equipment.
   2. 1.2 By executing this Agreement, the Client’s agrees to abide by the terms of this contract for the duration the client is in possession of the equipment.

2. 2 Caregivers Responsibilities

   1. 2.1 The Caregiver agrees to look after the Equipment on loan while the contract is in place.
   2. 2.2 It is the Caregiver’s responsibility to meet the cost of the six-monthly radio frequency device refurbishment.
   3. 2.3 The Caregiver must advise WSC if the client will be moving to a new address from the one provided and provide WSC the details of that new address. Such notification to occur prior to the move.
   4. 2.4 The Caregiver will immediately advise WSC if the Equipment is no longer needed and arrange with WSC a time for the equipment to be uplifted.
   5. 2.5 The Caregiver will promptly notify WSC in the event of the Equipment being lost, stolen or damaged.
   6. 2.6 Should a request be made to locate a lost device this may incur a $50 search fee. This charge is not related to a missing person search.
   7. 2.7 Should the device be permanently lost as a result of non-notification of any of the above circumstances, WSC may charge the client $350 for a replacement device.
   8. 2.8 The Caregiver will not allow anyone other than an authorised representative of WSC to perform service and repair work on the Equipment.
   9. 2.9 In the case of Radio Frequency devices, the caregiver will complete weekly checks using the Radio Frequency detector provided by WSC.
   10. 2.10 The Caregiver must notify WSC immediately after becoming aware of Equipment failure, damage or any issues affecting the operation of the Equipment.

3. 3 WSCs Rights and Responsibilities

   1. 3.1 WSC will supply/supply free of charge the agreed equipment.
   2. 3.2 If the Caregiver notifies WSC of Equipment faults or failure, it must take action to commence the service or repair process and restore the Equipment to service.
   3. 3.3 WSC will maintain the Equipment and in the case of Radio Frequency devices will service the equipment every six months with the cost met by the caregiver.
   4. 3.4 WSC will accurately record and keep updated all client information on the WSC confidential database.
   5. 3.5 Such information will be directly available to the NZ Police Search and Rescue teams to allow for successful search and rescue operations should this be required.

4. 4 Equipment

   1. 4.1 WSC may at any time exchange the Equipment so long as the substitute Equipment is capable of substantially performing the same function as the exchanged Equipment.
   2. 4.2 The Caregiver acknowledges that the Equipment, may be removed by WSC and/or its representative in accordance with the terms and conditions of this agreement.
   3. 4.3 WSC has given no representations or warranties regarding the quality, fitness for purpose, safety, performance or suitability of the equipment and no person is authorised by WSC to do so.
